FORCE MAJEURE NOTICE March 24, 2009 Beginning early on Monday, March 23, 2009, Eastern Wyoming began suffering from the effects a major winter storm. The severe nature of this storm has caused road closures throughout the area, making it impossible for our field personnel to access facilities. Field personnel responsible for the operation of downstream redelivery points have also been unable to get to work. Consequently MIGC LLC (MIGC) is unable to deliver all of the contracted firm quantities scheduled from MIGC along its system. Market cuts are being made by the downstream pipelines and will continue as needed until physical flows return to normal. We appreciate your patience and understanding during this unusual and difficult operating. Pursuant to Section 9 of the Transportation General Terms and Conditions to the FERC Gas Tariff, Second Revised Volume No. 1 of MIGC LLC, the severe weather conditions are not within the control of MIGC and is a force majeure event affecting MIGC’s ability to deliver full contracted firm quantities along the MIGC system under executed Transportation Service Agreements.
